Pre-nuptial Agreements

Prenuptial agreements are a means of deciding before marriage which pre-marital assets, if any, will be divided in the event of a divorce, and whether either party will be responsible for alimony or other financial obligations should the marriage end. These agreements can also address what will happen with jointly purchased assets, and what will occur in the event of the death of either party. Pre-nuptial agreements must meet certain statutory criteria to be valid. At the time of a divorce, pre-nuptial agreements may be challenged, so it is especially important that they be drafted and executed in accordance with the statutory criteria and case law.
